Govt can’t be held liable to compensate for deaths due to adverse event post administration of COVID-19 vaccines, Centre tells SC

The Center has told the Supreme Court that there is no evidence to support the state being held strictly liable for the tragic deaths of the respective children of the petitioners .  The vaccines used in the Covid vaccination programme are manufactured by third parties and are recognised as safe and effective.

The Centre also emphasised that there is no legal compulsion to get Covid-19 vaccine.

The Center’s response was given in response to a petition filed by the parents of two girls who had died as a result of side effects to the Covid vaccine.

In an affidavit, the Ministry of Health and Family Welfare stated that there was “no material to suggest how the state can be fastened with strict liability for the tragic death of the respective children of the petitioners,” which is what is necessary under the law to support a claim for compensation against the state under Article 32 of the Constitution.

According to the ministry, the vaccines used in the vaccination programme are manufactured by third parties, have successfully undergone regulatory review in India and other countries, and are recognised on a global level as safe and effective.

It said that, “Given these facts, it is most humbly submitted that holding the state directly liable to provide compensation under the narrow scope of strict liability for extremely rare deaths occurring due to AEFI (Adverse Events Following Immunization) from the use of vaccines may not be legally sustainable.”

The Health Ministry also stated that appropriate legal remedies, including approaching civil courts for a claim of damages or compensation for negligence, malfeasance, or misfeasance, are available to vaccine beneficiaries  or their families in the case that a person suffers physical injury or death as a result of an AEFI.

It said that while the deaths were tragic, the government could not be held liable and that such claims may be determined on a case by case basis in an appropriate court.

In the affidavit filed on November 23, the Health Ministry said that, although the government’s strong encouragement of vaccination for all eligible persons, there is no legal requirement for it.

The government’s response was in response to a petition filed by the parents of two girls who had died as a result of side effects from the Covid vaccine and who were being represented by advocate Satya Mitra.

In August , the apex court had issued notice to the centre on the parents request for an independent  committee to investigate the deaths along with the timely release of the autopsy and investigation . The petitioners also requested monetary compensation and guidelines for the prompt identification and treatment of persons suffering from adverse side-effects of Covid vaccines.

The petitioners’ legal representative claimed that the first petitioner’s 18-year-old daughter died in June 2021 after taking the first dose of Covishield in May 2021. The second petitioner’s 20-year-old daughter died in July 2021 after receiving the first dose of Covishield in June 2021.

Whereas notification No 52/DGHS/PH-IV/COVID-19/2020/prsecyhfw/13087-336 dated 13.06 2020, as further amended dated 20.11.2020 & 26.02.2022, in respect of The Delhi Epidemic Diseases, (management of COVID-19) Regulations, 2020 was issued.

And whereas, DDMA in its meeting held on 20.04.2022 noted that the positivity rate of COVID-19 infection has been increasing in Delhi over the past fortnight.

And therefore, the DDMA after examining all the relevant facts related to the issue of penal provisions for not adhering to the covid protocol of wearing of mask at public places, decided that, in relation to the clause 3(h) (c) whereby not wearing of face mask/cover in all public places has been made an offence, a fine of Rs. 500/- for not wearing of face mask/cover in all public places in Delhi will be imposed from immediate effect till further orders in compliance of Notification dated 26.02.2022. Further, the fine under this provision of the notification will not be applicable to persons travelling together in private four wheeler vehicles.

This issues with the prior approval of competent authority.

Various restrictions have been imposed in the State currently in order to curb the transmission of the COVID 19 virus. Now, based on the inputs of the Health department as well as the COVID Task force along with due consideration to the current COVID scenario in the State, the State Executive Committee (SEC) has decided to modify these.

State Executive Committee has decided to differentiate in response to the Covid 19 situation through restrictions or relaxations thereof, between various administrative areas depending upon the current risk profile of the area, appreciation of which should depend upon vaccination status, positivity rate of tests as well as occupancy of beds by patients.

Thereby, as decided & directed by the State Executive Committee in the meeting held on 25th February, 2022, the undersigned, in his capacity as Chief Executive Officer of the State Executive Committee, hereby promulgates the following directions, that will come into force from, 4rd March, 2022 from 0000 hrs across the State and will remain in force till the issue of any new order. This order is in super-cession of all the earlier orders issued for imposing/ relaxing of restrictions. The definition of status of fully vaccinated for an individual as well as general orders about Covid Appropriate Behaviour continue to apply and are reproduced in the end for ready reference. It is also declared that in case there is any activity that is not covered by this order, all GOI guidelines for that activity shall be applicable, and that in case of an activity finding mention in both, stricter of the two shall apply.

A. Administrative Units

1. Municipal Corporations shall be dealt as separate Administrative Units and rest of the districts shall be dealt as single separate Administrative Units

2. An Administrative Unit fulfilling all the following criteria shall be included in List

a. First dose vaccination is more than 90%.

b. Second dose vaccination is more than 70%.

B. Status of these parameters is dynamic and thus District Disaster Management Authority shall declare periodically the status of these parameters for all Administrative Units under it, for information to public and in case current status of parameters demand inclusion or exclusion from list A, DDMA shall declare so, under intimation to SDMA. Restrictions for controlling the spread of Covid 19 virus shall change as soon as an exclusion or inclusion occurs, in sync with the provisions herein.

C. Requirement of being fully vaccinated

i. All staff of all the establishments that cater to public at large shall necessarily be fully vaccinated.

ii. All home delivery staff shall necessarily be fully vaccinated.

iii. All users of any public transport must be fully vaccinated.

iv. All visitors to malls, theatres, natyagrihas, tourist places, restaurants, sporting events, religious places where general public also visits must be fully vaccinated.

v. DDMAs may enforce requirement of fully vaccinated on any public service wherein there is a possibility of interaction with other citizens and wherein such interaction may cause spread of Covid 19 and wherein Covid Appropriate Behaviour (CAB) may not be effectively implementable.

vi. All staff working in any office or establishment, public or private that has a dealing with general public must be fully vaccinated.

vii. All staff engaged in any industrial activities must be fully vaccinated.

D. Social/ Sports/ Entertainment/ Academic/ Cultural/ Religious/Political/ Festival Related events, including those relating to Marriages and Funerals and other gatherings and congregations are permitted in Administrative Units included in List A to the extent of 50% of capacity of the venue; however, whenever a gathering is expected to be of more than 1000 persons, DDMA shall be informed and DDMA may put reasonable restrictions on the same.

For the Administrative Units not finding mention in list A, total attendance in any of such gathering or congregations shall be limited to 50% of the capacity of the venue or 200 whichever is lower. E. Offline classes may resume in all academic institutions, subject to any orders of concerned administrative department of Government of Maharashtra. Administrations of all academic institutions are encouraged to leverage hybrid model of imparting education though online and offline modes. All pre-schools as well as Aanganwadis can now be restarted physically as well. All these institutions, establishments shall scrupulously follow CAB.

F. All home delivery services are allowed for all Administrative Units.

G. All shopping complexes, cinema halls, restaurants & bars, sports complexes, gyms, spas, swimming pools, religious places, natyagrihas, tourist places, entertainment parks etc. are allowed to operate with 100% capacity in Administrative Units included in List

A. For other Administrative Units that are excluded from List A, these shall operate at 50% of the capacity.

H. There shall be no restrictions for inter-state and intra-state movement for fully vaccinated For persons who are not fully vaccinated, inter-state movement is subject to production of negative RT-PCR test valid for 72 hours. There shall be no need for any NOC for such travel, not required otherwise than for purposes of DMA. I. All offices, including government and private, may function with full capacity.

J. All industrial and scientific institutions may function with full capacity.

K. Any activity not included in here, are allowed to the extent of 100% capacity in the administrative areas falling in List A and 50% for the remaining areas. In case of any issues of interpretation, DDMA shall provide the final interpretation.

L. DDMAs to be authorised to impose restrictions stricter than provided her; with prior consent of SDMA. It is expected that DDMAs shall meet frequently, as and when required but at least once a week to take the stock of the situation and to react to any trend.

M. Districts are instructed to press for 100% vaccine coverage of all eligible beneficiaries in an accelerated manner. Door-to-Door vaccination drives must be undertaken in Administrative Units not covered in List A. Though currently vaccination status of less than 18 years of age citizens is not included in the list of criteria mentioned in Para B, with passing time, it may be included. Precautionary dose and adolescent dose to be taken up for eligible people.

DDMA to also ensure that all staff in schools including teachers and non-teaching staff are GOI guidelines and advisories for vaccination must be adhered to scrupulously. N. Public Health department should provide all information regarding current Covid situation, testing infrastructure etc to the community at large for avoiding any misinformation and Community involvement to be encouraged by the districts and strict enforcement of norms to be ensured for CAB. Evidence based information to be made available to the community regularly.

O. It may be noted finally that situation of Covid 19 is ever evolving as thus all DDMA and SDMA officials must be alert and informed of daily situation. These orders shall remain in operation till modified due to any emergent situation.

Whereas, an Order of even number dated 27th December 2021, was issued to ensure compliance with the containment measures for COVID-19, as conveyed vide Ministry of Health & Family Welfare (MoHFW) DO letter No. Z.28015/318/21-EMR, dated 21st December, 2021, which was further extended for a period upto 28.02.2022 vide Order of even number, dated 27.01.2022;

And whereas, in view of the significant decline in the COVID-19 cases across the country, MoHFW vide D.O. letter No. Z.26015/1/2022-DM Cell, dated 18th February, 2022, has issued an advisory to all the States and Union Territories (UTs), stressing the need to follow a risk assessment based approach on the opening of economic activities;

Whereas, in exercise of the powers conferred under section 6(2)(i) of the Disaster Management Act, 2005 (DM Act), the National Disaster Management Authority (NDMA) has directed the undersigned to issue an Order, for containment of COVID-19 in the country;

Now, therefore, in exercise of the powers, conferred under Section 10(2)(1) of the DM Act, the undersigned, hereby directs the State/ UT Governments and State/ UT Authorities to implement a risk assessment based approach on the opening of economic activities, as conveyed vide aforesaid MoHFW advisory, dated 18th February, 2022, as per Annexure-I, until 31.03.2022. It is further directed that the National Directives for COVID-19 Management, as specified in Annexure II, shall continue to be followed throughout the country.

This is regarding measures that need to be taken in view of the sustained decline in the number of new Covid-19 cases across the country. From time to time, this Ministry has been advising and guiding the States/UTs regarding recommended strategies for testing, surveillance, containment and restrictions keeping in view the District as a unit.

2. Taking into account the significant decline in the Covid-19 cases across the country, the States have been undertaking various measures to reopen economic and social activities. There is a need to follow a risk assessment-based approach on the opening of economic activities without losing the gains made so far in the fight against the virus.

3. In this context, this Ministry’s earlier guidance shared with States/UTs on multiple occasions regarding the recommended strategies for testing, surveillance and containment based restrictions, keeping the District as a unit for decision making, are still valid.

4. Evidence-Based Decision making: At the district level there should be constant review of emerging data based on a sustained and critical level of testing to facilitate decision for restrictions/relaxation based on evidence. Such decisions should be taken at State/UT level after proper analysis of the local situation, such as the emergence of new cases/clusters, case positivity, population affected, the geographical spread of cases & hospital infrastructure preparedness.

5. Broad-based framework for relaxation/restrictions: In order to identify areas where restrictions need to be imposed/continued in districts/areas, the following broad-based framework is provided to aid States UTs: S. No. Parameter Thresholds 1 Test positivity Test positivity of 10% or more in the last week OR 2 Bed occupancy Bed occupancy of more than 40% on either oxygen supported or ICU beds

a) States need to watch the trajectory of cases in particular geographies to ensure that the areas reporting positivity rate above 10% and/or bed occupancy more than 40% on either oxygen supported or ICU beds should undertake required enforcement, containment, and restriction measures.

b) As the case trajectory may vary from State to State and there would be variation in the spread of infection within States also, there is a need to take decisions with respect to containment and restriction measures primarily at the local/sub-national level by concerned State and District Administration.

c) Continued focus on community participation for adherence to Covid Appropriate behavior including proper wearing of mask and physical distancing (2 gaz ki doori), as directed under the national directives for Covid-19 management under Disaster Management Act, will however be important measures to be undertaken across the country.

6. Some of the strategic. areas of intervention focusing on containment, test, track, surveillance, clinical management, vaccination and Covid Appropriate Behaviour to be taken up are as follows:

I. Relaxation in various activities duly following the National Directives for Covid-19 management under Disaster Management Act

i. Focus will be on graded relaxation to support the resumption of economic activities.

ii. Social/sports/entertainment/academic/cultural/religious/festival-related and other gatherings and congregations may be resumed. The decision for allowing these activities shall be taken up by the concerned States duly guided by the principles as enunciated above.

iii. Offline classes can be resumed in academic institutes without any restrictions. However, the school administration may also leverage a hybrid model of imparting education through online and offline modes.

iv. Marriages and funerals/last rites may be allowed.

v. All shopping complexes, cinema halls, restaurants & bars, sports complexes, gyms, spas, swimming pools, and religious places may be allowed to operate at full capacity.

vi. Public transport (railways, metros, buses, cabs) to operate without any capacity restrictions.

vii. There shall be no restrictions on inter-state and intra-state movement including transportation of essential goods.

viii. All offices, both government and private, may function without any capacity restrictions.

ix. All industrial and scientific establishments, both government and private may be allowed.

x. While allowing all such activities, it is imperative that the national directive including use of mask & physical distancing shall be strictly followed in all public places.

xi. The activities as mentioned above are primarily indicative and States/UTs should make a careful analysis of the local situation, areas to be covered, and extent of case positivity and transmission to decide on the relaxations/restrictions. Such decisions by States/UTs must be linked to the local epidemiological situation of Covid-19, based on a sustained critical level of testing and monitoring of case positivity.

II. Testing and surveillance:

States will continue with the strategy of ‘Test-Track-Treat-Vaccinate’ and implementation of Covid Appropriate Behavior across the district as the ongoing strategy in managing COVID-19.

a) Ensure sustained critical level of testing as per the testing guidelines.

b) Monitoring of Influenza-like illness (ILI) & SARI cases to be taken up in all Health facilities for early warning signals of the spread of infection.

c) The surge in cases including clustering of cases should be monitored. d) States to ensure continued focus on genomic sequencing of international passengers, collection of samples from sentinel sites (identified health facilities) and local clusters of cases, duly following the guidelines laid by MoHFW to capture early warning signals on variants.

III. Clinical Management

i. States to ensure sufficient availability of dedicated Covid health infrastructure as per the ongoing case trajectory.

ii. Ensure that Home isolation protocol is followed wherever required for asymptomatic and mild cases and specific monitoring shall be continued for high-risk cases.

iii. Non-Covid health services shall also be fully operationalized in all health facilities.

iv. Vaccination: Ensure 100% coverage of left out first and second dose eligible beneficiaries in an accelerated manner. Special focus to be given to those districts where the first & second dose coverage is less than the national average. The door-to-door vaccination campaign need to be strengthened. Similarly, precaution dose & adolescent vaccination shall also be taken up for all eligible people.

As far as schools are concerned, the district administration, in collaboration with school management, may ensure vaccination of all teaching and non-teaching staff.

All activities, like restaurants, gym, spas, sports, swimming pools, etc. considered for resumption of services shall promote 100% vaccination of the eligible staff.

v. Community engagement and Covid Appropriate Behaviour: Ensure advance engagement and information so that there is no misinformation or panic, transparent communication on hospital and testing infrastructure availability, regular press briefings etc. Participation of community backed by strict enforcement is necessary for ensuring Covid Appropriate Behaviour. Evidence-based information shall be regularly made available to the community accordingly

MANAGEMENT

1. Face covering: Wearing of face cover is compulsory in public places; in workplaces; and during transport.

2. Social distancing: Individuals must maintain an adequate distance in public place and at work places.

3. Spitting in public places will be punishable with fine, as may be prescribed by the State/ UT local authority in accordance with its laws, rules or regulations.

4. Screening & hygiene: Provisions for hand wash or sanitizer will be made at work places.

5. Ventilation: In closed places, proper ventilation should be ensured.

1. Name of the Scheme: PM CARES for Children

2. Vision:

Hon’ble Prime Minister of India on 29.05.2021 has announced comprehensive support for children who have lost both their parents due to COVID 19 pandemic.

3. Objective:

To ensure comprehensive care and protection of children who have lost their parent(s) to COVID pandemic, in a sustained manner, enable their wellbeing through health insurance, empower them through education and equip them for self-sufficient existence with financial support on reaching 23 years of age. The PM CARES for children scheme inter alia provides support to these children through convergent approach, gap funding for ensuring education, health, monthly stipend from the age of 18 years, and lump sum amount of Rs. 10 lakh on attaining 23 years of age.

4. Period:

The eligible children shall be enrolled from 29.05.2021 (date of announcement of Hon’ble PM) to 31.12.2021 to avail benefits of PM CARES for Children Scheme. The Scheme is expected to continue till the year when every identified beneficiary1 shall turn 23 years of age.

5. Eligibility:

All children who have lost

  1. Both parents or
    1. Surviving parent or
    1. legal guardian/adoptive parents/single adoptive parent

due to COVID 19 pandemic, starting from 11.03.2020 the date on which WHO has declared and characterized COVID-19 as pandemic till 31.12.2021, shall be entitled to benefits under this scheme.

  1. Child should not have completed 18 years of age on the date of death of parents

6. Entitlements:

i. Support for Boarding and Lodging:

  1. Efforts will be made by the District Magistrate with the assistance of Child Welfare Committee (CWC) to explore the possibility of rehabilitating the child within her/his extended family, relatives, kith, or kin.
    • If the extended family, relatives, kith or kin of the child are not available/not willing/not found fit by CWC or the child (aged 4 -10 years or above) is not willing to live with them, the child should be placed in foster care, after due diligence as prescribed under the Juvenile Justice Act, 2015 and rules made thereof as amended from time to time.
    • If the Foster family is not available/not willing /not found fit by CWC, or the child (aged 4 -10 years or above) is not willing to live with them, the child should be placed in age appropriate and gender appropriate Child Care Institution (CCI).
    • Children more than 10 years old, not received by extended families or relatives or foster families or not willing to live with them or living in child care institutions after the demise of parents, may be enrolled in Netaji Subhash Chand Bose Awasiya Vidyalaya, Kasturba Gandhi Balika Vidyalaya, Eklavya Model Schools, Sainik School, Navodaya Vidyalaya, or any other residential school by the District Magistrate, subject to the respective scheme guidelines.
    • It may be ensured that the siblings stay together, as far as possible.
    • For non-institutional care, financial support at the prevailing rates prescribed under the Child Protection Services (CPS) Scheme shall be provided to Children (in account with guardian). For child in institutional care, a maintenance grant at the prevailing rates prescribed under the Child Protection Services (CPS) Scheme shall be given to Child Care Institutions. Any provision for subsistence support under the State scheme may also be provided additionally to the children.

ii. Assistance for Pre-school and School Education

a. For children below 6 years of age

Identified beneficiaries will receive support and assistance from the Anganwadi services for supplementary nutrition, pre-school education/ ECCE, immunization, health referrals, and health check-up.

b. For children below 10 years of age

  1. Admission shall be provided in any nearest school as a day scholar i.e. Government/ Government aided School/ Kendriya Vidyalayas (KVs)/ Private Schools.
  2. In Government Schools, two sets of free uniform and textbooks shall be provided, under Samagra Shiksha Abhiyan, as per the scheme guidelines.
  3. In private schools, tuition fees shall be exempted under section 12(1)(c) of RTE Act.
  4. Under circumstances where child is unable to receive above benefits, the fees, as per the RTE norms, will be given from the PM CARES for Children scheme. The Scheme will also pay for expenditure on uniform, textbooks, and notebooks. A matrix of such entitlements is detailed out in Annexure-1.

c. For children between 11-18 years of age

  1. If the child is living with the extended family, then admission in the nearest Government/ Government aided School/ Kendriya Vidyalayas (KVs)/ Private Schools as a day scholar may be ensured by the DM.
  2. The child may be enrolled in Netaji Subhash Chand Bose Awasiya Vidyalaya/ Kasturba Gandhi Balika Vidyalaya/ Eklavya Model Schools/Sainik School/ Navodaya Vidyalaya/ or any other residential school, by the DM, subject to the respective scheme guidelines.
  3. The DM may make alternative arrangements for accommodation of such children during vacations at CCIs or any appropriate place.
  4. Under circumstances where child is unable to receive above benefits, the fees, as per the RTE norms, will be given from the PM CARES for Children scheme. The scheme will also pay for expenditure on uniform, textbooks, and notebooks. A matrix of such entitlements is detailed out in Annexure-1.

d. Assistance for Higher Education:

  1. The child will be assisted in obtaining education loan for Professional courses /Higher Education in India
  2. Under circumstances where beneficiary is unable to avail interest exemption from extant Central and State Government scheme, then the interest on the educational loan will be paid from PM CARES for Children Scheme.
  3. As an alternative, scholarship as per the norms will be provided to the beneficiaries of the PM CARES for Children Scheme from the schemes of Ministry of Social Justice and Empowerment, Ministry of Tribal Affairs, Ministry of Minority Affairs, and Department of Higher Education. Beneficiaries will be assisted through National Scholarship portal for availing such entitlements. The scholarship awarded to the beneficiaries will be updated on the PM CARES for Children portal.

iii. Health Insurance:

  1. All children will be enrolled as a beneficiary under Ayushman Bharat Scheme (PM-JAY) with a health insurance cover of Rs. 5 lakhs.
  2. It shall be ensured that the child identified under PM CARES for Children scheme receives benefits under PM JAY
  3. The benefits available to children under the scheme are at Annexure- 2.

iv. Financial Support:

  1. The lump sum amount will be transferred directly in the post office account of beneficiaries upon opening and validation of the account of the beneficiaries. A pro-rata amount will be credited upfront in the account of each identified beneficiary such that the corpus for each beneficiary becomes Rs. 10 lakhs at the time of attaining 18 years of age2.
  2. Children will receive monthly stipend once they attain 18 years of age, by investing the corpus of Rs 10 lakhs. The beneficiary will receive stipend till they attain 23 years of age.
  3. They will receive an amount of Rs. 10 lakh on attaining 23 years of age.

7. Nodal Agencies – National, State, and District:

Ministry of Women and Child Development shall be the nodal Ministry for execution of the scheme at the central level. Department of Women and Child Development or Department of Social Justice in the State/UT Government, dealing with the Child Protection Services scheme in the State/UT shall be the nodal agency at State level. The District Magistrates (DM) shall be the nodal authority at District level for execution of the scheme.

i. Role of the Ministry of Women and Child Development:

  • The Ministry shall implement the scheme in coordination with the State and District nodal agencies.
  • The Ministry shall provide oversight and guidance to the State and district authorities.
  • The Ministry shall host and maintain the portal containing the details of beneficiaries, with the assistance of National Informatics Centre (NIC).
  • The Ministry shall coordinate with the PM CARES Fund for release of funds to account of the District Magistrates.
  • The Ministry shall coordinate with the DMs for transferring corpus amount to the post office account of beneficiaries and for other expenses related to education, health, and other activities.
  • The Ministry shall leverage PM CARES for Children portal to coordinate with stakeholder ministries such as Ministry of Education, Ministry of Health and Family Welfare, Ministry of Social Justice and Employment, Ministry of Tribal Affairs, Ministry of Minority Affairs or any other ministry, department or organisation for facilitating the scheme.
  • The Ministry shall submit reports to PM CARES Fund regarding the beneficiaries, as and when required.
  • The Ministry shall be assisted by a Program Management Unit (PMU), for managing the portal, for overall coordination, including, coordinating with the States/Districts authorities, release of funds, chartering growth of children, generating required reports and monitoring the process. Joint Secretary (Child Welfare) in the Ministry shall supervise the PMU.

ii. Role of State/UT Governments:

  1. The department of Women and Child development or the department of Social Justice in the State/UT implementing the Child Protection Services scheme shall be the nodal department for the scheme. Additional Chief Secretary/ Principal Secretary/ Secretary of the department shall be the State Nodal Officer for implementation of PM CARES for Children Scheme.
  2. The said department shall supervise the actions taken by all the districts for care and protection of the children receiving support under this Scheme on a long-term basis, till they attain 23 years of age.
  3. The department shall coordinate with health, education, and other State departments in order to help district magistrates in facilitating services and benefits for children.
  4. The departments shall monitor the progress made in case of every child and facilitate inter-state transfer for the purpose of higher studies, sports, professional training, or any other purpose in the best interest of child.

iii. Role of District Magistrate

  1. The District Magistrate shall anchor the scheme in the District
  2. The DM (by designation) shall act as the guardian3 of these children, under this scheme, for all practical purposes.
  3. Identification, registration, and verification – The DM shall identify the beneficiaries with the assistance of Child Welfare Committee (CWC) and District Child Protection Unit (DCPU). After satisfying themselves regarding the authenticity of the beneficiary, she/he will verify and confirm the details of the child on the PM CARES for Children portal.
  4. For the purpose of this scheme, DM may include an ADM, who has been duly authorized by the DM.
  5. Account identification – For receiving of funds from MoWCD, DM will either identify an existing account or open a new account and map the account details on the PM CARES for Children portal.
  6. Opening of account – DM shall be responsible for opening of account of the beneficiaries with assistance of concerned district authorities.
  7. Transfer of funds to the PM CARES beneficiaries account – Upon opening of the account and its validation, DM shall transfer the eligible corpus amount to the beneficiaries account. (Para no. 8(iv)&(v) refer)
  8. DM shall also raise request for funds, through the portal, to the concerned Ministries/Departments for educational, health, and other activities for children. These funds shall be utilized for expenditure on activities not covered under the existing schemes.

i) Annual activities –

  1. Update the Child’s profile on the portal
  2. DM may interact personally with the children at least once in a year
  3. Review their education and health parameters
  4. Organize supplementary education and career counselling facility to the beneficiary

j) Additional key activities –

  1. Provide immediate assistance in terms of boarding and lodging, if required
  2. Satisfy herself/himself before placing the child with non-institutional care or within CCI, that the action is being taken in the best interest of child
  3. May ensure that the siblings stay together, as far as possible.
  4. Change the residence of the child if it is found that the child is under duress in the present circumstances
  5. Provide benefits to the child under existing schemes of the Government, as per the eligibility

  • New Logistics division created under Department of Commerce for integrated development of the logistics sector
  • Remission of Duties and Taxes on Exported Products (RoDTEP) scheme and Rebate of State and Central Levies and Taxes (RoSCTL) Scheme being implemented with effect from 01.01.2021
  • 12 Champion Services Sectors have been identified for promoting and diversifying services exports by pursuing specific action plans
  • Districts as Export Hubs has been launched by identifying products with export potential in each district
  • Package announced in light of the COVID pandemic to support domestic industry.

The Government has taken the following measures since 2014 to boost the India’s export:

  1. A new Foreign Trade Policy (FTP) 2015-20 was launched on 1st April 2015. The policy, inter alia, rationalised the earlier export promotion schemes and introduced two new schemes, namely Merchandise Exports from India Scheme (MEIS) for improving export of goods   and ‘Services Exports from India Scheme (SEIS)’ for increasing exports of services. Duty credit scrips issued under these schemes were made fully transferable.
  2. The mid-term review (2017) of the Foreign Trade Policy (2015-20) was carried out and corrective measures were undertaken.
  3. Foreign Trade Policy (2015-20) extended by one year i.e. upto 31-3-2022 due to the COVID-19 pandemic situation.
  4. A new Logistics Division was created in the Department of Commerce for integrated development of the logistics sector. 
  5. Interest Equalization Scheme on pre and post shipment rupee export credit was introduced from 1.4.2015 to provide cheaper credit to exporters.
  6. The Government started implementing a NiryatBandhu Scheme with an objective to reach out to the new and potential exporters including exporters from Micro, Small & Medium Enterprises (MSMEs) and mentor them through orientation programmes, counselling sessions, individual facilitation, etc., on various aspects of foreign trade for enabling them to get into international trade and boost exports from India.
  7. Assistance provided through several schemes to promote exports, namely, Trade Infrastructure for Export Scheme (TIES) and Market Access Initiatives (MAI) Scheme.
  8. A comprehensive “Agriculture Export Policy” was launched on 6th December, 2018 to provide an impetus to agricultural exports.
  9. A Central Sector Scheme, ‘Transport and Marketing Assistance for Specified Agriculture Products’ was launched for providing assistance for the international component of freight to mitigate the freight disadvantage for the export of agriculture products.
  10. Remission of Duties and Taxes on Exported Products (RoDTEP) scheme and Rebate of State and Central Levies and Taxes (RoSCTL) Scheme have been implemented with effect from 01.01.2021.
  11. Common Digital Platform for Certificate of Origin has been launched to facilitate trade and increase Free Trade Agreement (FTA) utilization by exporters.
  12. 12 Champion Services Sectors have been identified for promoting and diversifying services exports by pursuing specific action plans.
  13. Districts as Export Hubs has been launched by identifying products with export potential in each district, addressing bottlenecks for exporting these products and supporting local exporters/manufacturers to generate employment in the district.
  14. Active role of Indian missions abroad towards promoting India’s trade, tourism, technology and investment goals has been enhanced.
  15. Package has been announced in light of the COVID pandemic to support domestic industry through various banking and financial sector relief measures, especially for MSMEs, which constitute a major share in exports.

This information was given by the Minister of State in the Ministry of Commerce and Industry, Smt. Anupriya Patel, in a written reply in the Rajya Sabha today.

In modification of previous order No.300/ DCHS/PH-1V /COVID-19/RAT & FU/2020/PF-1/2447-2456 dated 04/08/2021 the rates for conventional RT PCR test and Rapid Antigen Tests for COV1D-19 in Delhi by Private sector Labs is fixed as per details below

Further, all labs will ensure that samples are processed latest within 12 hours of being received in the lab with all positive results being updated on ICMR portal mandatorily within 30 minutes of samples being processed followed by updation of all negative results latest within 24 hours from the receipt of samples in the lab.

Dear Shri Mansukh Bhai Ji,

Subject : Corona Virus : Currency Notes may carry infection

We invoke your urgent attention towards our earlier communications sent to your learned predecessor and ICMR beginning from 6th September, 2020 requesting for a clarification on whether currency notes are carrier of virus or not. This clarification assumes much significance in the wake of current scenario of Corona pandemic. We deeply regret that even after passing of 15 months neither Ministry under your command and ICMR have not given any clarification. We wish to obtain this clarification because large number of traders & consumers across Country are dealing in currency notes and if these are prove to be carrier of virus, then we should be able to remain cautious while handling of currency notes.

We would like you to clarify whether currency notes are a potential carrier for viruses including Covid or Various credible studies have revealed that currency notes carry major risk of containing various virus which may lead to number of infectious diseases. In the wake of current Corona virus and for other precautionary reasons, we request you for an early clarification from the Govt.

It is in the public domain that the currency notes are most vulnerable to health of people and are easy carrier of communicable diseases and as such a proper investigation is all the more needed and the Government should bring out a comprehensive policy to promote alternative mode of payments including digital payments coupled with incentives and benefits to encourage more and more people for adoption and acceptance of alternate mode of payments in the larger interest of health of the Countrymen.

We would further like to add that corona virus is an infectious disease which may spread by close contact of any person infected with such virus. Even if due precautions are taken, yet avoidance of cash usage can not be avoided and as such it becomes one of the most easy carrier for spreading any virus. Therefore, immediate steps should be taken to check spreading of any virus through currency notes.

It’s a fact that currency notes carry micro-organisms that can cause diseases and infections. Experts have warned that several diseases, including urinary and respiratory tract infections, skin infections and recurrent meningitis, are being transmitted through currency notes. They can also contribute to causing septicaemia and toxic shock syndrome

Subject Inclusion of the offices of Chartered Accountants and Income Tax Practitioners under “Exempted category”

Madam/Sir,

This is with reference to the letter dated 12.01 2022 received from CIT(ITA), Central Board of Direct Taxes. Department of Revenue, Ministry of Finance. Govt of India thereby requested for exempting Chartered Accountants and Income Tax Practitioners from the restrictions imposed vide Para-4(i) of DDMA Order F No 60/DDMA/COVID-19/2021/509 dated 11 01.2022

In this context, I am directed to inform you that the aforementioned request has been examined and considered by the Competent Authority, hence. the “Offices of Chartered Accountants and Income Tax Practitioners’ is hereby included in the list of ‘Exempted Category’ as prescribed in DDMA’s GRAP Order No. 460 dated 08.08.2021.

This issues with the approval of the Competent Authority.

ORDER

Whereas, the Delhi Disaster Management Authority (DDMA) is satisfied that the NCT of Delhi is threatened with the spread of COVID-19 Virus, which has already been declared as a pandemic by the World Health Organization and has considered It necessary to take effective measures to prevent its spread and has issued various orders/instructions from time to time to all authorities concerned to take all required measures to appropriately deal with the situation in NCT of Delhi;

2. And whereas, DDMA has issued Order No. 500 dated 28.12.2021 and subsequent Order No. 504 dated 04.01.2022 (copy enclosed) with regard to permitted I prohibited I restricted activities in NCT of Delhi till further orders;

3. And whereas, the COV1D-19 situation in Delhi has again been reviewed In DDMA meeting held on 10.01.2022 under chairmanship of Hon’ble Lt. Governor and it has been observed that numbers of COVID-19 cases (including the cases of Omicron variant) have been rapidly increasing over the last few days & positivity rate has crossed 23%.Therefore. It has been felt necessary that some more additional restrictions are required to be imposed in Delhi to contain the spread of COVID-19 virus, including the highly contagious and transmissible Omicron variant.

4. Now, therefore, in continuation of DDMA Order No. 500 dated 28.12.202111 subsequent Order No. 504 dated 04 01 2022 and in exercise of powers conferred under section 22 of the Disaster Management Act, 2005, the undersigned, in his capacity as Chairperson, State Executive Committee, DDMA, GNCTD, hereby directs that in the territory of NCT of Delhi (outside Containment Zones), the following additional activities shall also be prohibited/restricted with immediate effect till further orders:

(i) All Private Offices shall be closed, except those which are falling under the ‘Exempted Category as prescribed in DDMA’s GRAP Order No. 460 dated 08.08.2021. The practice of work from home shall be followed.

(ii) All Restaurants & Bars shall be closed. However, restaurants will be allowed only for home delivery / takeaway of food items.

5. In case any person is found violating the aforesaid instructions. the defaulting person(s) shall be proceeded against as per the provisions of section 51 to 60 of the Disaster Management Act, 2005, Section 188 of IPC and other applicable laws, besides imposition of fines as per notification of Health & Family Welfare Department, GNCTD.

6. All District Magistrates, District DCPs, Zonal Deputy Commissioners / concerned authorities of Municipal Corporations / New Delhi Municipal Council! Delhi Cantonment Board and all other authorities concerned shall take necessary action for ensuring compliance of this order in their respective areas and shall adequately inform and sensitize the field functionaries about the same for strict enforcement. in letter and spirit.

7. This order shall not prohibit any further restrictions / measures imposed by any other Department or Authority or Institution empowered under any relevant law to control the spread of COVID-19 virus as well as for any other purpose.
